GUIDELINES
APPENDIX TO
BALMORAL RESORT COMMUNITY GENERAL BYLAWS
Each alteration/addition shall be considered on an
individual basis, with consideration being given to whether or not it interferes
with the outlook/view of neighbors, and/or the general environment. The AL
Committee will make a recommendation and it will be submitted to council for a
decision.
Modification/Alterations/Additions/
Sunrooms/Shade Structures (at the back of the home
only): [form and detailed plans required]
City of Kelowna requires a building permit.
Please obtain for insurance reasons and please forward a copy to Council

All additions to be color coordinated as per existing structure.
- Roof and walls to be of exactly the same materials as
the existing structure (unless glass is used)
- No wind blocks to be added as part of, or to be added to
additions on existing structures.
- Patios are not to be extended to accommodate any
additions
Glassed-in Patios (at the back of the home only): [form
and detailed drawings required]
City of Kelowna requires a building permit.
Please obtain for insurance reasons and please forward a copy to Council.
- The glass must be tempered or wire-bound.
- The canopy must not extend beyond the existing concrete
patio slab.
- The structure must match the house siding and trim
material.
- The canopy must be supported by posts no smaller than
4”x 4” and there must be 1 post for every 10 feet of canopy width. The posts
must be trimmed or finished, as per existing posts, i.e. Aluminum/vinyl
covered.
- The structure must be fitted with the same “eaves
troughing” as the main structure.
Awnings/Shades:( at the back of the home only) [form
not required]
- Retractable awnings only and must be consistent in color
with the exterior trim of the residence[beige tones]. Drop shades may be
permitted provided they are of good quality and the color is consistent with
the exterior trim of the residence.
Patio: [form and detailed drawings required]
- Concrete extensions must be the same surface [finish] as
originally installed by the developer. An extension may not exceed 2 feet
beyond the original patio as provided by the developer.
- No external wood structures.
- Front yard patios/courtyards must be consistent with
those originally placed by the developer.
Arches/Rose Arbors/Trellises: [form not required]
- These items shall be free standing and removable.
- Must not obstruct yard maintenance activities.
Landscaping: [form required]
- In order to ensure a continuous view of lawns and
gardens, the basic planting and shape of gardens is to be maintained. No
enlarging of flowerbeds is permitted. Owners who wish to plant trees, hedges
or large shrubs (over 4 feet at maturity) must give the name and type of
plant, tree, shrub or hedge, the height at maturity and the location of the
same on the strata lot.
- Any additional or replacement trees must not exceed 16
feet at maturity.
- Additional cedar trees are allowed subject to a maximum
of 10 cedars per regular lot and 14 cedars for a corner lot.
Pyramidal cedars along the fence on Stillingfleet Road and
by Sandstone and Sunrise Village are to be trimmed to a height of 71/2 ft;
with the exception of homes at the far end of the complex [400 homes] which
council agreed [May20, 2005] could be 8 ft. for privacy reasons. All other
pyramidal cedars along the fences will be trimmed to the height of the fence.
Pyramidal cedars in private yards will be limited to a height of 6 ft.
Cedars around the green Fortis Boxes will be maintained at 3 feet to allow for
improved visibility
Edging [forms not required]
- Only two types of edging are to be used as Strata
Council has decided to keep our landscape as natural as possible to maintain
continuity in our development:

Trenching, (as a form of edging) to be done by the homeowner or a
professional landscaper.

Commercial Black Plastic Edging to be installed by the homeowner or a
professional landscaper.
Lava rock [forms not required]
- Acceptable only within the courtyard for safety
reasons.
Outside Lighting: [forms not required]
- Ground decorative lighting permitted only in areas not
interfering with grounds maintenance. Spotlights will not be permitted (out
of consideration for neighbors).
Painting: [forms not required]
- All improvements, including repainting etc. must use the
same color as used on the original structure, with the exception of the front
door.
Shingles: [forms required]
- Shingle replacements or additions must be of material as
close in color and texture as those presently in place.
Privacy Fences: [forms required]
- May be permitted on a per case basis and maintenance
will be the homeowner’s responsibility and expense.
Exhaust Fans: [forms required]

Exhaust fans on the roof must be the low profile electric type.
Flower Baskets and/Or Flower Brackets: [forms not required]

Not to be hung from lampposts, as they are common property and not at the
front of the garage as they may block the view of house numbers.
Mailboxes: [forms not required]

To be installed within proximity of main door of unit but preferably not
visible from the street.
Flag Brackets, Flag Sizes and Flying Times: [forms not required]

Standard flag bracket to be used and must be mounted at the side of garage
(not the garage door). Maximum flag size is not to exceed 3 x 5 feet. Only
official national flags may be flown and these only on national holidays.
Decorative Signs [forms not required] Maximum of one per strata lot

Signs must be constructed of either metal or wood and must be properly
maintained.

One rectangular sign, not to exceed 30” long and 8” wide or one round / oval
sign, not to exceed 18” in diameter. The signs are to be installed either
above the garage door, on courtyard gate or at the front door.
Fish Pond [Forms required]
- Must be contained within existing shrub beds. [Backyards
only]
- Must be oval shaped and not exceed 4.5 ft. in length and
cannot be more than 60 gallons capacity.
- Must be covered with a fixed safety screen with openings
no larger than 4 inches and screen must be at least 18 gauge steel to
withstand danger of anyone falling through the screen. Any access opening must
be locked. Water level must be below the screen.
- Must be equipped with the ability to be drained with a
garden hose to the nearest storm sewer or acceptable drain. It may not be
drained onto the strata lots or any parkways. Water level in the pond is to be
maintained at a reasonable level to prevent overflow in case of heavy
rainfalls.
- Must be equipped with a circulating pump which must be
running at all times including the winter months, unless it has been drained
and covered.
- Any placement of ornamental rocks to facilitate a
waterscape, associated with the fishpond, must be at the side or end of the
pond, within the existing shrub bed and must not exceed 3.5 feet in height at
the highest point.
- Homeowners are responsible for covering liability issues
on their homeowner’s. insurance policies, Strata Corporation will not be
responsible for any liability issues in connection with the fish ponds.
